Care Proceedings

If Social Services have written to you with concerns about your child, it’s completely normal to feel afraid and anxious.

You might be wondering what your rights are and what steps you should take. Whether you’ve been informed that the matter may be taken to court or you’ve been invited to a Pre-Proceedings meeting I can support you through this process.

Legal Aid May Be Available to You

If you’re a parent or someone else with Parental Responsibility—such as a relative with a Residence Order or Child Arrangement Order—you are usually eligible for Legal Aid. This means your legal costs can be covered, regardless of your financial circumstances.

Non-Accidental Injury (NAI)

Non-Accidental Injury (NAI) refers to injuries sustained by a child for which the parents cannot provide a reasonable explanation, leading professionals to suspect the injury was deliberately caused. Medical professionals are required to report such cases to children’s social services, who may seek the Court’s permission to remove the child from parental care.

If social services approach you regarding NAI, it is critical to seek legal advice immediately.

NAI can present in various forms, from minor bruises or cuts to more severe injuries like fractures or head injuries, often referred to as shaken baby syndrome.

This area of children’s public law is highly specialized, which is why it’s essential to engage a solicitor who has experience in handling NAI cases. If social services have approached you, please contact me as soon as possible, even outside of normal working hours, to ensure you have the right support.

Common Types of Non-Accidental Injuries Include:

  • Head Injuries: From impact or shaking (e.g., shaken baby syndrome), including skull fractures and brain injuries.
  • External Injuries: Bruises, bites, burns, or cuts.
  • Bone Fractures.
  • Fabricated or Induced Illnesses: For example, poisoning.
  • While many NAI injuries are indeed inflicted deliberately, there may be other causes, including:

  • Ehlers-Danlos Syndrome, a genetic condition that makes the skin fragile and prone to bruising.
  • Sudden Infant Death Syndrome (SIDS) or other unexplained causes.
  • Vitamin deficiencies that can predispose a child to easy bleeding.

Medical Expert Evidence

It is crucial to obtain independent expert medical evidence in NAI cases. Experts such as paediatriciansradiologistsneuro-radiologistshaematologistsgeneticists, and other specialists will be required to analyze the evidence thoroughly. I have the experience and expertise to identify the right experts for your case and work closely with them to determine whether the evidence supports abuse or has a medical explanation.

Criminal Investigation

If you are accused of inflicting an NAI on a child, the police may investigate, potentially leading to interviews or arrest. I work closely with criminal defence specialists to ensure comprehensive representation in both the criminal and care proceedings.

Barristers Representing You at Court

I collaborate with experienced barristers who specialize in NAI cases across England and Wales. Identifying the right barristers is essential, as the case will involve complex fact-finding hearings and cross-examination of evidence and witnesses.

NAI cases require specialized knowledge and representation. It is vital to secure expert legal assistance immediately. I am here to provide the support you need and ensure the best possible representation during this challenging time.
